New Changes to Eviction Timelines: What Housing Providers Need to Know

AB 2347, is changing how housing providers handle evictions. This law gives tenants more time to respond to an eviction notice and introduces new rules for court hearings. It’s important to understand these changes so you can adjust your process.

What’s Changing?

More Time for Tenants to Respond
Tenants now have 10 days (instead of 5) to answer an eviction notice. Weekends and court holidays do not count, so this adds a full extra week.
New Motion to Strike Option for Tenants
Tenants can now file a motion to strike to remove parts of the eviction complaint they believe are wrong. This may slow down the process.
Faster Hearings for Housing Providers
If a tenant files a motion to strike or a demurrer (which challenges the case), the court must now hear it within 5 to 7 days instead of the previous 30-day wait.

What This Means for You

As a housing provider, these changes could extend the eviction process, but also speed up certain court decisions. Here’s what you should do:

  1. Plan for Longer Eviction Timelines: Since tenants have more time to respond, expect delays in the process.
  2. Prepare for Faster Court Hearings: If a tenant challenges the eviction, be ready to present your case quickly. The new law requires shorter waiting times for key legal decisions.
  3. Understand the Motion to Strike: Tenants can now challenge specific parts of an eviction notice. This means housing providers must be careful when drafting complaints to avoid mistakes.
